When a defendant is arrested by a police officer or picked up on a district court bench warrant or arrest warrant, he or she will be typically be brought to a police station and booked. The booking process includes fingerprinting a photographing. In certain cases, the police may try to question a defendant prior to booking, but our advice is to request an attorney immediately. Requesting a lawyer will end all questioning regardless of what any officer says. After being booked a defendant will then be brought before a District Court Commissioner for an initial appearance. Some defendants who are arrested on bench warrants (such as failures to appear) will be taken straight to the commissioner upon being served with the warrant. The commissioner will inform the defendant of the charges and advise of the right to have an attorney. After the advisements the commissioner will then make a determination about pre-trial release. All defendants have the right to have an attorney present at this initial appearance, which is the first opportunity to secure release. Experienced representation at the initial appearance could mean the difference between immediate release and spending the night (or more if it’s a weekend/holiday) in jail. Benjamin has secured the release of countless defendants at the first appearance, which makes it all the more important to contact a lawyer immediately.
Any defendant who is not released by the commissioner will then be taken to the Baltimore County Detention Center on Bosley Ave. The next business day he or she will appear remotely for a bail review in front of a District Court judge. District Court bail reviews in Baltimore County are currently being held Monday through Friday excluding court holidays at 1 p.m. in the Towson District Court on Chesapeake Avenue. It is important to retain an attorney in a timely fashion so he or she can obtain a copy of the charging documents and prepare for the hearing. District Court judges have a reputation for hesitating to release defendants on felony charges involving firearms, large amounts of narcotics or crimes involving violence such as domestic assault and robbery. There is some truth to this reputation as Maryland is one of the stricter states when it comes to pre-trial release. In some states defendants charged with any non-capital offense are presumed to be entitled to pre-trial release, but Maryland judges do not subscribe to this theory. Add in the fact that a civilian can file serious charges against another person with very little proof, and you are left with an extremely flawed system that could keep your loved one in custody. Benjamin believes that every minute behind bars is a minute too long, and he does everything in his power to fight for the release of his clients. If you need a Baltimore County bail review lawyer Benjamin Herbst is standing by to help. Benjamin is also an experienced Habeas Corpus bail review lawyer, and will fight for any incarcerated defendant in Circuit Court if bail is denied at the District Court level.

"I am writing this letter to thank you for doing such a great job in my case. If it were not for what you did I would still be in jail right now. My family and I are very grateful I have a second chance at life now, and if it wouldn't be like this if you were not so good at what you do. Thank you again Benjamin!" T.S.

"Thank you for all the time and effort that you put into defending my case. You were willing to fight for me when nobody else would believe my story, and you did not back down from the prosecutor. Another lawyer would have urged me to plead guilty, but you were willing to fight for me, and in the end justice was served. I appreciate everything you did and wish you all the best." Fred D.
